13. Disclaimer of Warranties; Limitation of Liability
THE SITE AND ITS CONTENT AND SERVICES ARE PRESENTED “AS IS.” WE MAKE NO REPRESENTATIONS OR WARRANTIES OF ANY KIND WHATSOEVER, EXPRESS OR IMPLIED, IN CONNECTION WITH THESE SITE TERMS OF SERVICE OR THE WEBSITE OR ITS CONTENTS OR SERVICES. YOU AGREE THAT WE WILL NOT BE RESPONSIBLE OR LIABLE IN CONTRACT, WARRANTY OR IN TORT (INCLUDING NEGLIGENCE) FOR ANY (a) INTERRUPTION OF BUSINESS; (b) ACCESS DELAYS OR ACCESS INTERRUPTIONS TO THE WEBSITE; (c) DATA NON-DELIVERY, MISDELIVERY, CORRUPTION, DESTRUCTION OR OTHER MODIFICATION; (d) LOSS OR DAMAGES OF ANY SORT INCURRED AS A RESULT OF DEALINGS WITH OR THE PRESENCE OF OFF-WEBSITE LINKS ON THE WEBSITE; (e) COMPUTER VIRUSES, SYSTEM FAILURES OR MALFUNCTIONS WHICH MAY OCCUR IN CONNECTION WITH YOUR USE OF THE WEBSITE, INCLUDING DURING HYPERLINK TO OR FROM THIRD PARTY WEBSITES (f) ANY INACCURACIES OR OMISSIONS IN CONTENT OR (g) EVENTS BEYOND OUR REASONABLE CONTROL. FURTHER, WE WILL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING OUT OF OR IN CONNECTION WITH THE USE OF THE WEBSITE. THIS IS A COMPREHENSIVE LIMITATION OF LIABILITY THAT APPLIES TO ALL DAMAGES OF ANY KIND, INCLUDING BUT NOT LIMITED TO, ANY INDIRECT, SPECIAL, INCIDENTAL, PUNITIVE OR CONSEQUENTIAL DAMAGES, LOSS OF DATA, INCOME OR PROFIT, LOSS OF OR DAMAGE TO PROPERTY AND CLAIMS OF THIRD PARTIES.

If any part of these warranty disclaimers or limitations of liability is found to be invalid or unenforceable for any reason or if we are otherwise found to be liable to you in any manner, then our aggregate liability for all claims under such circumstances shall not exceed the amount paid by you to the Company through the Site during the prior twelve (12) months.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for damages. Accordingly, some of the above indemnities, limitations, and disclaimers may not apply to you. To the extent we may not, as a matter of applicable law, disclaim any warranty or limit our liability, the scope and duration of such warranty and the extent of our liability will be the minimum permitted under such law.

14. Indemnification

This indemnification obligation will survive the termination of the Terms of Service and your misuse of the Site(s) and Services. You also agree to indemnify us for any loss, damages, or costs, including reasonable attorneys’ fees, resulting from your use of software robots, spiders, crawlers, or similar data gathering and extraction tools, or any other action you take that imposes an unreasonable burden or load on our infrastructure.

15. Waiver; Remedies
The failure of LBP to partially or fully exercise any rights or the waiver of LBP of any breach of these Terms of Service by you shall not prevent a subsequent exercise of such right by LBP or be deemed a waiver by LBP of any subsequent breach by you of the same or any other term of these Terms of Service. The rights and remedies of LBP under these Terms of Service and any other applicable agreement between you and LBP shall be cumulative, and the exercise of any such right or remedy shall not limit our right to exercise any other right or remedy.

16. Dispute Resolution
PLEASE READ THIS SECTION CAREFULLY- IT MAY SIGNIFICANTLY AFFECT YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT TO HAVE A JURY HEAR YOUR CLAIMS. IT CONTAINS PROCEDURES FOR MANDATORY BINDING ARBITRATION AND A CLASS ACTION WAIVER.

For purposes of this Section (Dispute Resolution), “LBP,” shall include its subsidiaries, affiliates, agents, employees, predecessors in interest, successors, and assigns.

If you and LBP have a Dispute (defined below) and our customer service team is unable to resolve the concern, you and LBP agree to make a good faith effort to resolve it informally prior to initiating a formal arbitration proceeding. The party that intends to initiate an arbitration proceeding must first send a verified Notice to the other party that describes the Dispute. The Notice must include the initiating party’s name and contact information (address, telephone number, and email address), sufficient information to enable the other party to identify any transaction at issue; and a detailed description of (1) the Dispute, (2) the nature and basis of the claims, and (3) the nature and basis of the relief sought, with a detailed calculation. Your Notice shall be sent by email to: [email protected] or by mail to: LBP, Inc., Attn: General Counsel 331 NW 26th St. Ste 103, Miami, FL 33127. You must personally sign the Notice. LBP’s Notice shall be sent to the most recent contact information we have on file for you. If requested by the party that receives the Notice, the other party must personally appear at and participate in a telephone settlement conference (if a party is represented by counsel, counsel may also participate) to discuss the Dispute. If the Dispute is not resolved within sixty (60) days after receipt of the Notice (which period can be extended by agreement of the parties), you or LBP may commence a formal dispute resolution proceeding consistent with the process set forth below. Compliance with and completing this informal dispute resolution process is a condition precedent to filing any formal dispute resolution proceeding, including a demand for arbitration. The statute of limitations and any filing fee deadlines shall be tolled while the parties engage in this informal dispute resolution process. If the sufficiency of a Notice or compliance with this informal dispute resolution process is at issue, it may be decided by a court at either party’s election, and any formal dispute resolution proceeding shall be stayed pending resolution of the issue. A court of competent jurisdiction shall have the authority to enforce this condition precedent to arbitration, which includes the power to enjoin the filing of a complaint or prosecution of a demand for arbitration.

If we are unable to resolve the Dispute through the mandatory informal dispute resolution process, you and we agree that, except as set forth below, you unconditionally consent and agree that you are required to resolve any claim that you may have against the site or our services on an individual basis in arbitration. You and we agree that any disputes between us (including any disputes between you and a third-party agent of the company) will be resolved through binding and final arbitration and not in a court. The sole exceptions to the foregoing requirement to arbitrate are that: (1) either party may assert individual claims in small claims court if those claims otherwise qualify for small claims court and as long as the matter remains in such court and is not removed or appealed to a court of general jurisdiction and advances only on an individual (non-class, non-representative basis); and (2) each party may bring suit in court to enjoin infringement or other misuse of intellectual property rights. This includes, but is not limited to any claim, dispute, or controversy (whether in contract, tort, or otherwise) you may have against company and/or its parent, subsidiaries, affiliates and each of their respective officers, directors and employees (all such individuals and entities collectively referred to herein as the “company entities”) arising out of, relating to, or connected in any way with the site or the determination of the scope or applicability of this agreement to arbitrate. Such dispute will be resolved exclusively by final and binding arbitration administered by the American Arbitration Association (“AAA”) and conducted before a sole arbitrator in accordance with Consumer Arbitration rules. The AAA Rules and filing forms are available online at www.adr.org, by calling the AAA at 1-800-778-7879.

The parties agree that the arbitrator (“Arbitrator”), and not any federal, state, or local court or agency, shall have exclusive authority to resolve any disputes relating to the interpretation, applicability, enforceability, or formation of this Arbitration Agreement, including any claim that all or any part of this Arbitration Agreement is void or voidable. The Arbitrator shall also be responsible for determining all threshold arbitrability issues, including issues relating to whether the Terms are unconscionable or illusory and any defense to arbitration, including waiver, delay, laches, or estoppel.

By agreeing to individual arbitration, you understand and agree that you are waiving your right to maintain other available resolution processes, such as a court action or administrative proceeding, to settle any disputes or claims. The rules in arbitration are different. There is no judge or jury. Although review is limited, an arbitrator can award on an individual basis the same damages and relief as would be available in court, and must enforce the same limitations stated in these Terms as a court would.

The arbitration will be administered by the AAA in accordance with the Consumer Arbitration Rules then in effect. The rules of the arbitral forum will govern all aspects of this arbitration, except to the extent those rules conflict with these Terms. The rules are available at this link https://adr.org/sites/default/files/Consumer%20Rules.pdf.

Notwithstanding any choice of law or other provision in the Terms, the parties agree and acknowledge that this Arbitration Agreement evidences a transaction involving interstate commerce and that the Federal Arbitration Act, 9 U.S.C. § 1 et seq. (“FAA”), will govern its interpretation and enforcement and proceedings pursuant thereto. It is the intent of the parties that the FAA and AAA Rules shall preempt all state laws to the fullest extent permitted by law. If the FAA and AAA Rules are found to not apply to any issue that arises under this Arbitration Agreement or the enforcement thereof, then that issue shall be resolved under the laws of the state of Florida , without regard to its conflict of laws provisions.

To begin an arbitration proceeding, after satisfying the condition precedent identified above, you must (1) send a verified and personally signed demand for arbitration that describes (a) the nature and basis of your claims, and (b) the nature and basis of the relief sought, including a detailed calculation to: Luxury Brand Partners, LLC Att. General Counsel, 331 NW 26th St., STE 103, Miami, FL 33127, and (2) contact AAA and follow the appropriate procedures with AAA to commence the arbitration. Payment of all filing, administration and arbitrator fees will be governed by the AAA Consumer Rules then in effect.

The parties shall be responsible for their own attorneys’ fees and costs in arbitration, unless they are authorized by law or the arbitrator determines that a claim was frivolous or brought for an improper purpose or in bad faith. In addition, the provisions of Federal Rule of Civil Procedure 68 shall apply and be enforced by the arbitrator. This section will not apply in California.

The arbitration may be conducted by telephone, based on written submissions, or in person in the county where you live or at another mutually agreed location as set forth in the AAA rules. If requested, you shall personally appear (with your counsel if you have one) at an initial telephone conference with a case manager before an arbitrator is appointed.

Unless you and we agree otherwise in writing, in the event that any provision of this section is found not to apply to you or to a particular claim or dispute as a result of a decision by the arbitrator or a court order, any claim or dispute that has arisen or may arise between you and us must be resolved exclusively by a state or federal court located in Miami-Date, Florida. You and we will submit to the personal jurisdiction of the state or federal courts located within Miami-Date County, Florida for the purpose of litigating all such claims or disputes.

Regardless of the manner in which the arbitration is conducted, the arbitrator shall issue a reasoned written decision sufficient to explain the essential findings of fact and conclusions of law on which the award is based. Judgment on the award may be entered in any court having competent jurisdiction. This clause shall not preclude the parties from seeking provisional remedies in aid of arbitration from a court of competent jurisdiction. An arbitrator’s decision shall be final and binding on all parties.

With the exception of disclosures to affiliates and legal counsel, all negotiations and arbitration proceedings related to a dispute (including a settlement, award, or the documents and briefs exchanged or produced during arbitration) are confidential and may not be disclosed by the parties except to the extent necessary for interim measures or conservatory relief, the enforcement of an arbitration award, or as required by law.

17. Class Action Waiver
You and we each agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. This means that you and we each agree to arbitrate in our individual capacities only, not as a representative of a class, a member of a class, or a Private Attorney General. Likewise, an arbitrator may not consolidate more than one person’s claims and may not otherwise preside over any form of a representative or class proceeding.

If a court determines that any of the prohibitions on non-individualized relief; class, representative, and private attorney general claims; and consolidation are unenforceable with respect to a particular claim or with respect to a particular request for relief (such as a request for injunctive relief), and all appeals from that decision have been exhausted (or the decision is otherwise final), then the parties agree that that particular claim or request for relief may proceed in court but shall be stayed pending arbitration of the remaining claims. Specifically, and notwithstanding anything to the contrary in this Section 16 (Dispute Resolution), the arbitrator may not issue a “public injunction” and any such “public injunction,” if permitted, may be awarded only by a federal or state court. If either party is permitted to seek a “public injunction,” all other claims and prayers for relief must be adjudicated in arbitration first and any such prayer or claim for a “public injunction” in federal or state court stayed until the arbitration is completed, after which the federal or state court can adjudicate the party’s claim or prayer for “public injunctive relief.” In doing so, the federal or state court is bound under principles of claim or issue preclusion by the decision of the arbitrator.

Special Additional Procedures for Mass Arbitration: If twenty-five (25) or more similar claims are asserted against LBP by the same or coordinated counsel or are otherwise coordinated (and your claim is one such claim), you understand and agree that the resolution of your Dispute might be delayed. You also agree to the following process and application of the AAA Multiple Consumer Case Filing Fee Schedule and Supplementary Rules. Counsel for the claimants and counsel for LBP shall each select ten (10) cases (per side) to proceed first in individual arbitration proceedings as part of a bellwether process. The remaining cases shall not be filed or deemed filed in arbitration nor shall any AAA fees be assessed in connection with those claims until they are selected to proceed to individual arbitration proceedings as part of a staged process. If the parties are unable to resolve the remaining cases after the conclusion of the initial twenty (20) proceedings, the parties shall participate in a global mediation session before a retired state or federal court judge, and LBP shall pay the mediator’s fee. If the parties are unable to resolve the remaining matters in mediation at this time, each side shall select twenty (20) cases (per side) to proceed to individual arbitration proceedings as part of a second bellwether process. (If there are fewer than forty (40) claims remaining, all shall proceed.) The remaining cases shall not be filed or deemed filed in arbitration nor shall any AAA fees be assessed in connection with those cases until they are selected to proceed to individual arbitration proceedings as part of a staged process. A single arbitrator shall preside over each case. Only one case may be assigned to each arbitrator as part of a bellwether process unless the parties agree otherwise. If the parties are unable to resolve the remaining cases after the conclusion of the forty (40) proceedings, the parties shall participate in another global mediation session before a retired state or federal court judge, and LBP shall pay the mediator’s fee. If the parties are unable to resolve the remaining matters in mediation at this time, this staged process shall continue with one hundred (100) cases proceeding at one time that are selected randomly or by the AAA in staged sets, until all the claims included in these coordinated filings, including your case, are adjudicated or otherwise resolved. Between staged sets of proceedings, LBP agrees to participate in a global mediation session should your counsel request it in an effort to resolve all remaining claims. The statute of limitations and any filing fee deadlines shall be tolled for claims subject to this Dispute Resolution section from the time the first cases are selected for a bellwether process until the time your case is selected, withdrawn, or otherwise resolved. A court of competent jurisdiction shall have authority to enforce this paragraph and, if necessary, to enjoin the mass filing or prosecution of arbitration demands against LBP. Should a court of competent jurisdiction decline to enforce these “Special Additional Procedures for Mass Arbitration,” you and we agree that your and our counsel shall engage in good faith with the assistance of a Process Arbitrator to devise and implement procedures that ensure that arbitration remains efficient and cost-effective for all parties. Either party may engage with the AAA to address reductions in arbitration fees.

18. Opt-Out Procedure Applicable To All Consumers
Notwithstanding any provision to the contrary, we agree that if LBP. makes any future changes to this Dispute Resolution section (other than a change to the mailing or email address), you may reject any such change by sending us written notice personally signed by you within thirty (30) days of the change to the address provided above. This is not an opt-out of arbitration altogether. By rejecting any future change, you are agreeing that you will arbitrate any dispute between us in accordance with the language of this Dispute Resolution section.

19. Choice of Law/Forum Selection
In any circumstances where this Arbitration Agreement permits the parties to litigate in court, the Terms of Service shall be governed by the laws of the State of Florida as if the Terms of Service were a contract wholly entered into and wholly performed within Florida. You further expressly consent and agree to submit to the exclusive jurisdiction and venue of (i) a state court of competent jurisdiction located in Miami-Dade, Florida, or (ii) the United State District Court for the Southern District of New York.

20. Text Messaging (SMS) Terms of Use

IdealogueBlog_Paintedhair_1180x660

As a salon owner, stylist, and mom, the rose golds and pearl tones Patricia Nikole paints on clients every day is responsible for inspiring over 330,000 followers on Instagram through her coloring technique, Painted Hair. From her studio in Northern California, she’s building a brand rooted in her personal style that gives her clients versatility while having a strong point of view.

Idealogue x Painted Hair

I’m blessed, because I’ve had amazing opportunities right here in my own hometown – and that’s good- not only for my personal brand, but also for my family.  I like showing people that no matter where you’re from, you can be successful. As long as you’re doing exceptional work and people love what you have to offer, they’ll follow to you on the moon.

I’m originally from Sacramento, but I started out in Georgia doing apprenticeships.Funny story here- In my first apprenticeship, I had a situation where in order to get credit for work, your employer is supposed to submit hours quarterly —  only mine didn’t. I worked there for a whole nine months before finding out I wasn’t credited at all! I lost all that time! School wasn’t an option for me because I couldn’t afford it…I then decided to work anywhere I could to get my foot in the door. I happened to walk into an Aveda Salon one day, hoping to take whatever role they had available. Even if that meant taking a position as a secretary, not even doing hair, at this point I was desperate. I met the loveliest manager while filling out an application. She was very interested to learn the purpose of my visit and what my thoughts were on pursuing an education in hair. When I walked out I suddenly had a full-ride scholarship, a sense of relief and accomplishment, and excitement for the new opportunities that were to come! It was the beginning of my start; and it would inevitable pave the way and lead to how I learned my technique. Overcoming adversity is so important in this industry, and without my setback with the apprenticeship, I would have never walked into Aveda and I wouldn’t be where I am today.

LBP: How’d Painted Hair come about?

I’ve long been obsessed with doing more for my clients, and after leaving Aveda the biggest question I couldn’t stop asking myself, was “how I could make my color look more natural, and less harsh?,” so I started with painting to learn my own way to do it myself.

The name itself didn’t come until much later. In the beginning, social media started out as necessity for me. I’m a Mom with two kids, and wasn’t able to get out and network like my peers did, so I used the internet instead – posting photos to MySpace, then sending friend requests to people in my zip code. When Facebook came out, I did the same thing. I used social media strategically to grow my client base, and I was lucky to be an early user of it.

About four years ago, I had branded all my pages Hair by Patricia Nikole. And one day, my friend told me, “Patricia, I love your page, but your name is too long.”  So we talked, and at one point I remember saying, “well, I paint hair – why don’t we call it Painted Hair?” I still can’t believe someone didn’t have that name! So I took it and ran with it. People don’t even call me by my name anymore at shows! It’s “Hi Painted Hair.” Finding the right name was such a blessing for me – it’s what I feel defines me and what I identify with.

Now that I have a bigger audience, I can be more efficient with my time. The different channels on social media have different strengths and weaknesses, and if you aren’t careful, you might find yourself spread too thin. By the time Instagram came out, I remember realizing that it would be the best place for me to focus because I wanted to showcase my work. After the name change, I had seen my following grow so rapidly! I decided that if I could get enough people to follow me on Instagram, I could use my audience there to build my other platforms. Focusing and building a huge audience on one platform is like getting yourself a big megaphone. I just started on Snapchat – and so I told people about it on my Instagram account and now they follow me. I still work behind the chair every day, and efficiency is so important to juggling all the things I need to do.

paintedhair-006

LBP: How’d you connect to so many people?

It’s not the most exciting answer, but to be honest I’ve gotten to where I am now with steady growth over time – and I think people need to know that. It was never a big explosion of followers for me, I just kept working extremely hard. After a while, more and more people reposted my page, and then more and more people started seeing it. I think the thing to always keep in mind is that working hard isn’t always exciting- but the reward is.

LBP: Were there any challenges to getting here?

Well, that last part is why I have a watermark on all my photos now. We’re stylists and visual people, and we love to share the things that inspire us, but at the start, I remember getting messages from people that were like “so-and-so is using your photo as their own work,” and that was tough for me! I work really hard at what I do, and sometimes I just wondered, ‘why share what I’m doing when people will just steal it?’ Not to mention, just think about all these clients being deceived! But quitting isn’t how the world works. If you’re not sharing, on these platforms or elsewhere, you won’t grow your clientele, you won’t reach as many people, and you won’t ever get out of your shell. Initially, I designed something because I needed a way to ensure that when my work got reposted, people knew it was mine, and after a while, it became my trademark. Like my experience in Georgia, out of every negative there’s a positive – my audience came from working hard, putting in the time, having faith that it would work out, and not giving up.

paintedhair-007

LBP: How has the industry changed since you’ve been in it?

I feel like people are more informed when they sit in my chair. A few years back, I remember my clients would always bring in magazines to tell me what they wanted. The style and trend was all driven by editorial coverage and what celebrities were doing. But now, while celebrities still have a big impact, people aren’t looking at print for inspiration, they’re going to social media, learning about what’s new, finding the people who are doing it well, going to the source, and asking for it. They come in already knowing what I can do, and they want me to achieve that same thing for them. I think social media is really positive for the industry in the way that everyone is able to carve out a niche for themselves with their own style; we’re all growing together and attracting the right clients who fit with us and what our strengths are.

No lines — that’s my inspiration. I approach every client with the thought that if you leave my chair, I would wear your hair. I work by incorporating my style and personal way of doing things into all the appointments I have, and it’s helped me stay authentic and build a brand around an idea.  My goal is to continue getting better and better at what I do and what I’m known for. I work every day behind the chair as well as teach classes as an educator. I give my clients what they want, and I feel like if I spent too much time to doing what’s trendy, I would lose myself. It’s so easy to be influenced by all the great work out there – but my page needs to be me, I want to be solid and who I am. Together we could decide to do a silver, or a mauve, or a chestnut, but when you come to me, it’ll always be painted hair. The best referral I can get is a new client coming in and saying ‘what you’ve done on your page is what I want on my hair.’

Hairbrained-Story_1180x660

Gerard Scarpaci and Randy Taylor have a long history in the business as educators, stylists, salon owners, and community-builders. With their network, they were among the first in the industry to think about using digital media as a way to connect people, and in 2008, by applying the principles of what they were doing  in the classroom to online, created Hairbrained,  which has become the home of craft hairdressers online, boasting 27,000 community members using the Hb app, 120,000 followers on Facebook, 210,000 on Instagram and 35,000 on Twitter. This is the first of our three part interview with them spanning community, trial and error, and the future of social in the beauty industry.

Idealogue x Hairbrained: Part 3

Gerard: Well, to paraphrase one of the Idealogue speakers, Gary V,  as long as we’re creating 51% of the value we’ll be relevant. Whenever people connect with Hairbrained, if they feel like they walk away with more value than is taken away, we’ll be fine. It’s all about sticking with our plan to create something valuable for our community. Association, not media. We don’t worry about competition at all – we’ve got enough good people on the site that we’re able to create revenue that in turn helps us create better content for them. Randy’s now full-time creating media. We’ve got a full-time content creative house with him.

Randy: Now we’re able to create something like 30 pieces of high-quality educational content in two months. The 60-90 minute tutorials we mentioned before on Facebook live are off-the-hook and weekly. Gerard’s also full-time Hairbrained as of May 1 too. We just had to, it’s gotten so large. Previously both of us had other jobs – there’s no way we’ll stop doing hair, but it was a long time coming.

The thing that will never be replaced by technology, even augmented reality, I believe, is hands-on. We’ll see the  theory and pre-learning becoming more and more digital, while the student will then spend all their class time doing perfecting the craft with their hands.

Gerard4

LBP: What do you wish you could’ve done differently?

Gerard: Well, you know, I think we’ve always undervalued the things we can deliver for brands. And  maybe that’s because we started this whole thing when people only wanted that two-page spread in magazines. You can’t make someone value something they don’t value, and at the time, we’d pitch marketing teams so persuasively, but they just didn’t get it. And that was tough. They’d spend their money on more trade magazines, and we’d be like – but no one can click on it! I don’t think it was until this year that people have started to see digital as a smart way to promote their brands. We were ahead of the game, because we had to be, and now the machine’s catching up.

GerardKelly&Randy

LBP: As keepers of a social network yourself, do you think all the sharing allows for more creativity, or hinders it?

Gerard: Randy was the first person to say to me how worried he was about this culture. How it might be detrimental to the work. Our biggest fear was that people wouldn’t try new things and stop pushing the envelope to do things that they knew would get a lot of likes. And then everyone would start copying each other or whatever was getting the most likes, and unfortunately in an art and in a craft, what’s most popular is not really a sign of creativity or skill. When everybody starts creating work with the same goal, it had a tendency to get homogenized, and it was our goal that they could put photos up of what they like, what they’re doing, and what they care about instead of trying to please everyone else. That’s when the real magic happens – and we encourage that.

Randy: That’s the same story with Vidal Sassoon and his technique. At the time he launched his techniques in the early 60’s people said – that’s terrible, it’s disgusting, But because he believed in his work he went on to change the craft completely — he wouldn’t have changed the craft if he wondered how many likes he might get.

Gerard: When I see a photo i think is great, but I question if I should curate it, I look at the craft behind it. Craft over mass, every time.

This is the first of our three part interview with them spanning community, trial and error, and the future of social in the beauty industry.

Idealogue x Hairbrained: Part 2

Randy: One of the things that struck me the most after hitting that point was how people started ‘picking’ themselves. Once we removed the barriers to sharing work and communication, people started to rising to the top based on merit, not simply connections. It really is incredible how fast some of these kids are meeting and even surpassing us in terms of their cachet in the industry. It’s something that often rubs people the wrong way. That whole idea of getting peeved that while we had to work year after year to get where we are, these kids are moving fast and don’t “deserve” the popularity they’re getting. Hairbrained was the first part of that movement and I’m proud of how it’s shaken things up.

Gerard: Hairbrained is a conversation, not a one-way street. But after that milestone, we realized that we had an opportunity to start curating that content to reach more people who might be interested in learning from it, too. And that’s where the Facebook page came in. While the community itself was on its own site with a login, once Facebook opened up to everyone, people were there – and so we decided we’d take the best of what we were seeing in our community, and curate it for Facebook. We’ve got something like 120,000 page followers now? Then Instagram became an extension that was ideally suited for images. We basically set the precedent and the template for curating work submitted socially.

We didn’t have plans for any kind of promotional marketing, either. But that was about the time that we met people like Reuben Carranza, Cory Couts, who would ask us, are you guys accepting media promotion? We were like, well – we haven’t thought about it, but people do spend a lot of money going to all these events and shows, so we built a sponsorship model that we considered almost like public television for hairdressers. We weren’t the media, and frankly, didn’t want to be, but if you were supporting valuable content, we’d love to have you. For us, old marketing is dead. Supporting value, creating value for hairdressers, that’s what it’s all about. By about 2011, we had 8 or 9 sponsors, and then we launched eCommerce at around the same time. The tools are a big passion for us – we love the tools, share the tools, and when you’re doing classes, people are always asking things like, ‘what’s that comb, why is it better?’ We wanted to make our favorites available. It’s a labor of love.

Randy: There was this mantra about making it all about them. We just looked at everything, and whenever a new decision would come up, we’d ask ourselves, how do we make it about our members? It goes back to what Gerard was saying about empathy.

Gerard&Randy1

LBP: How do you know what’s right for the community?

Gerard: Well, as hairdressers it’s easy. We’ve got enough experience to know what people like — between the two of us, we have 50 years experience in the industry. My wife, kelly @hairbrainedko is a hairdresser too, who works with us.  Hairdressers are visual, so we ask ourselves, what’s visual that can we show people? And we test, test again, learn from our mistakes. We did things we thought were incredible and they failed. Remember the backstage project?

Randy: Oh yeah — we thought people would be thrilled to have a bird’s eye view of the best hairdressing in the world, backstage at runway shows. So we set up several Periscope broadcasts of masters like Tim Hartley, Eugene Souleiman, Sharon Blain and others at work backstage or during a presentation, and it flopped. Why? Because people couldn’t ask questions. You’re watching probably some of the most thrilling work in the industry, but Eugene’s job is to do hair. He can’t stop and explain anything to you, because he’s got to get the models out there. So it didn’t work. People just wanted to talk about what he was doing and connect with the artists.

Now, we’ve fixed that with our Hb Live broadcasts on Facebook videos –  they are set up specially for the online audience, and meant to address them only, it’s not a secondary thing because we know that people like to ask questions. We’ve had maybe like over 15 live broadcasts so far and probably somewhere around 1M views?

Gerard3

Randy: There’s a-ha moments every day, too.

Gerard: Have you seen what we’re doing with polling? It’s great. We’re able to get a wider swath of information about topics that impact our industry in hours. Advice every day. For instance, everyone’s up in arms. Instagram stories! What’s that all about? Will everyone leave Snapchat? We just put up a poll yesterday about this. One second, let me check.

Randy: 80% love it.

Gerard: 80% think they’ll use Instagram stories. Overnight and now we know. It’s 75 votes today, so not quite valid, but that’s what you get overnight with a big enough community. You get to see what people do, and understand how everyone thinks.

Idealogue x Hairbrained: Part 1

Gerard: This was back when Facebook was for college kids. We had MySpace, and we knew YouTube, so Randy started off by making videos of us. In 2008, I had to do those demos anyway – I was working for Aveda as an artistic director and an educator in New York, putting on traveling classes and running the NYC academy.

Gerard2

Randy: And I was an owner inside the network. I loved using Flip cameras and photography to capture what I was doing – I’m kind of a techno-enthusiast. Gerard and I met through his classes, and we started messing around, posting things online.

Gerard: At first, I didn’t know what to think. I didn’t know what social media meant! I barely used email at the time — but when Randy pitched me the idea of getting some classes online, I trusted him and thought, why not? So we started putting things on YouTube – and it was like, wow, we had 100,000 people watch this 25-minute demonstration? We might be on to something. We really flew under the radar for the first couple years and this was way before we had the community built.

There wasn’t a plan really – as an educator I was looking for a place to connect with my students. I noticed that when people would do classes, you spend a weekend with them and before you leave they’re hugging you, telling you that you changed their lives, and a year later, when you run into them on the street, it’s like ‘do I know you?’ It was such a missed opportunity. I felt that the follow-up connectivity was almost more important than the class itself, and we wanted to extend that indefinitely.

Randy: I also remember that feeling of having to wait in line.  As a photographer, it was this whole song and dance. Do a shoot, send it out to a magazine, wait three months, follow-up, wait another month, was it picked up? Wait more. It was kind of the old guard way of doing things.

Gerard: As hairdressers, I think we are naturally empathetic – it’s a skill you need if you want to be successful in this industry. Figure out other people’s needs, how to reach them on an emotional level. There wasn’t Instagram yet, and so people really didn’t have a way to show off their work. And yeah, Facebook was for college kids, so not many people we knew were on it. We wanted to have a place online where people could add their work and photos, ask questions, get likes and comments from members — those magical moments of connectivity that weren’t happening in the real world. That became Hairbrained.

LBP: Who are the kinds of people who join Hairbrained?

Randy: We have a term for our community — craft hairdressing. In what we consider craft, the first important thing is the work – the quality of what you’re creating is #1. The people who identify themselves as craft hairdressers think of what they do as a lifelong pursuit of mastering what you do with your hands

Gerard: The community has a huge age range – it’s so diverse. Hairbrained is for people who love hair. Maybe they got into the business thinking it was a job initially, but for our people, hairdressing is how they define themselves and their lifestyle. Scroll through their phones and 9 out of 10 contacts are other hairdressers, they’re looking at pictures of hair while they’re in bed, an new idea for a client pops into their head while they’re brushing their teeth.

It’s a big movement in this industry, and we’re going global year by year. The UK, Australia, Canada are our biggest markets outside of the US, and Germany is a huge opportunity for growth. There’s dozens of hundred members who have done special collaborations from meeting on the site.

Randy3

LBP: When did you know you had struck a chord?

Gerard: Well, it wasn’t right away. But what struck me was how fast it all happened. Everything started out because we had a network in the real world. And in this industry, if people value you, they’ll join in and support you. We knew people at most of the major brands, Paul Mitchell, Aveda, Sassoon and Wella, so we sent a message to friends of ours in the industry. And you think, 25 of my counterpart educators, inviting 10-20 people each week after classes. That’s when it really started to pick up. Once we had 10,000 in the Hairbrained community we knew we had something. There wasn’t a business plan — we just started, and right away those connective moments started to happen – we just built it and started inviting people.

Action pushes Alexis Thurston to achieve more. Whether she’s changing how stylists learn with her social learning platform Butterfly Circus, changing how color is marketed with her product brand Pulp Riot, changing the model of salon suites with UBungalows, or how a salon should be managed with Butterfly Loft, alongside her business and life partner, David Thurston, she’s always got a new project going that has the potential to move the industry into different spaces. We sat down with Alexis to talk about education, her outlook on social, and in the process, learned a little more about what a female role model looks like at the upper levels of beauty.

Idealogue x Alexis Thurston

Two heads are better than one. I’ve always thought you can achieve more as a group, than you can as an individual. Collaborating with other people gives you ideas that you wouldn’t have gotten otherwise, and vice-versa. It kicks off this infectious upward spiral of energy. That’s how Butterfly Circus got its start.

You get these a-ha moments when you’re washing dishes or working out, and one day while David was on the treadmill, he said, “I’ve got this idea I’d like to discuss with you”.

At the time product companies handled education and called the shots – they told you how to do things, big-names would come in to teach techniques, you’d visit a couple events per year. But that’s all changed. We [the beauty community] are the ones starting the trends, we’re the ones trying new things with clients, and thanks to social media, now we’ve got the channels to communicate those ideas from wherever we are. Instead of getting all our information from above, I’m looking to my peers for inspiration.  When I would scroll through my feeds, I’d see things from people and think, “wow, I’d pay money to learn from them.” So together we thought, why not get a handful of these awesome, unique, independent stylists together and create soundbites that anyone can learn from?

LBP: Was it hard to get off the ground?

The difference for us is that we don’t just have an idea and say oh that’s great and we’re done with it. We get an idea and we act on it. For some people, the hardest part is just taking the risk, you know? But for us, together we’ve learned that once you take that step, it’s funny how things fall into place. Each step gets easier and easier and brings you closer to your goal. It’s amazing how the universe brings people, places and things together when you embrace the risk and take a step. If you overcome the fear, the risk is worth it.

Butterfly Circus was born from seeing a change in the industry, fulfilling a need and creating a platform for new voices to be heard that might not have been otherwise. It’s really based in this idea that the way we learn is always evolving. When was the last time you sat and watched one person give a tutorial for three hours? Anything come to mind?

LBP: Not quite. That’s a long time to be sitting in front of a computer screen.

Exactly – if anything, you probably watch 10 minutes, skip forward a bit, maybe another five minutes and you’re done. It’s just not an effective method any more. Butterfly Circus is our project that is set up with this new way of learning in mind. We give 20-30 minute sound bites of information from 6 instructors, then comes back together at the end with a finished result. We’re changing the way education in our industry works.

It’s the same philosophy we have with our salon Butterfly Loft, and our color brand, Pulp Riot. I think it was Jim Collins who said, when everyone rows in the same direction, they row farther, and it’s more or less been our mantra for all our businesses. When someone starts or partners with us, we say, “jump in, the water’s fine.” Go for the ride, have an open mind, and go for it. Our job as owners is to set up an environment where everyone can achieve success, and then our team utilizes their passion and drive to make amazing things happen. That’s why we built our Ubungalows salon suites differently. We wanted people to have the ability to do things on their own, but with access to a community. Everything should be a win-win, and even if you’re an individual in the business renting our bungalows, you should feel like you’re a part of a greater community.

LBP: Sounds like there’s a lot going on.

To be honest, it’s challenging to manage sometimes. I’m a mom, wife, a business woman, salon owner, mentor, VP of two companies – that’s an understatement! There’s so many balls in the air — I’d be lying if I said things never slip through the cracks. But daily prioritization and a great support group is key to making it all happen. I’ve got two phones, but when I need to remember things, I write it all down. I write on post-it’s, I text message myself, but now I mostly use little notebooks that fit in my purse that I carry around everywhere. The last time David was in Miami,, he picked up about 15 of these cool R and Co. notebooks for me because my current one is almost filled out with notes and to do lists.  I have so many notes and know where to flip to to find them. We joke about how despite all the resources of today’s technology world, I still use my little notebook to write things down. – it’s almost comical!

LBP: And so how does social media fit in?

Online, the connections between the services make it easier for us, because we’re so busy. I’m 41 years old, and I didn’t grow up with these things. For me, embracing social media was a mind-shift. Did you know I almost closed my Instagram account two years ago?  It was when our salon account was building and I didn’t want the focus to be on myself. But soon enough I realized that as an owner and a leader, if I was going to tell other people to embrace technology, and the value in it,  to help them showcase their work, I needed to do it too.  I think I was the last person planet to join Facebook. As the channels have matured, we’ve seen that Instagram was the most important for our industry, but so many people are on Facebook, so I couldn’t just skip it completely. It can be overwhelming with all the different social media outlet channels, but now it’s all about baby steps – when we’re trying something new, we start small with one thing and keep adding.

In simplest terms, my perspective is, Instagram’s for showing your work, Facebook is for giving your content reach, and Snapchat’s for showing personality, but they all work together to connect people and bring opportunities. We use that understanding to our advantage with Pulp Riot. On Snapchat, we’ve got Riot takeovers that give stylists from all over control on our account to show themselves using the product and share their voice. We also created short videos of empowering stylists as artists and using Pulp Riot as their paint to create masterpieces and works of art through hair color. We’re constantly trying to stay ahead of the game and innovate ways of using social media. Probably by the time this article gets written we will have come up with something different. There’s a big advantage to those companies who are forged from the social media community, who are natives to it. It allows us to reach people faster – and make an impact in such a shorter time than others might have in the past. Social media isn’t going anywhere. And it’ll continue to evolve, so it’s important for people to see it as an opportunity instead of fear it. The latest is Instagram Stories. We know it’s sort of like Snapchat, but slightly different so we have to try it. How’s that going to shake out? I’m not sure, but you can bet I’m going to use it.

FullSizeRender-2

I am somebody who can operate in both the creative and business spheres and I’m very lucky to have those skills, because I can empathize as a stylist, an educator, as well as a business owner. I’ve always wanted to be a bold positive female role model in the beauty industry – and I think coming from the perspective of someone who wasn’t totally into social media at first has helped me a lot. I’ve seen how it’s helped my businesses, me personally, my staff and brought opportunity to all of us. It’s all back to the community/team aspect in our network and what we’re doing everyday…we win together. It’s about embracing change and not turning a blind eye to new platforms – although nothing makes you feel older than your 13-year old daughter teaching you how to use Snapchat.
